Terms of Service

1. About mytellme.app

mytellme.app is a testimonial collection and display service operated by Léo Blouin, sole trader (micro-entreprise), SIRET 94910538100022, 7 rue Léonard De Vinci, 35220 Saint-Jean-sur-Vilaine, France ("we", "us", "the Service").

By creating an account or using the Service, you agree to these Terms of Service in their entirety. If you do not agree, do not use the Service.

2. Plans and Features

The Service is available under two plans:

Free plan

• 1 survey.
• Up to 50 testimonials per survey.
• 1 video testimonial per survey.
• Wall of Love with up to 3 featured testimonials.

Pro plan

• Unlimited surveys.
• Unlimited testimonials and video testimonials.
• Wall of Love with unlimited featured testimonials.
• White-label (custom logo and colors).
• CSV export.
• Embeddable widget.
• Social media image generator.
• Email notifications (new response, expired collection, ...).

The Free plan is fully functional and allows you to evaluate the Service before upgrading. No free trial of the Pro plan is offered.

We reserve the right to modify plan features with reasonable prior notice.

3. Pricing and Billing

3.1 Prices

Prices are displayed in USD. Applicable taxes are calculated and added at checkout based on your location.

3.2 Payment processing

Payments are processed by Lemon Squeezy, LLC ("LemonSqueezy"), acting as Merchant of Record. Your purchase is therefore made from LemonSqueezy, who is responsible for billing, invoicing, and tax compliance worldwide. Your card details are never transmitted to or stored by us.

3.3 Renewals

Subscriptions renew automatically at the end of each billing period (monthly or annual). You will receive a receipt from LemonSqueezy before each renewal. You may cancel at any time before the renewal date to avoid being charged for the next period.

4. Cancellation and Refunds

4.1 Cancellation

You may cancel your Pro subscription at any time from your billing portal. Your Pro access remains active until the end of the current paid period. No data is deleted upon cancellation — your account reverts to the Free plan limits.

4.2 Right of withdrawal (EU consumers)

Under French law (Art. L221-18 Code de la consommation) and EU Directive 2011/83/EU, consumers have a 14-day right of withdrawal from the date of purchase, without giving any reason.

However, if you expressly request that the Service begin immediately upon payment (by checking the relevant box at checkout), you acknowledge that you waive your right of withdrawal once the Service has been fully performed or, where the service is ongoing, once you have begun using the Pro features.

To exercise your right of withdrawal, contact us at leoblouinpro@gmail.com within 14 days of your purchase. Eligible refunds are processed by LemonSqueezy within 14 days of the withdrawal request being accepted.

5. Acceptable Use

You agree not to use the Service to:

• Collect testimonials that are false, fabricated, or misleading.
• Publish content that is defamatory, hateful, obscene, or otherwise unlawful.
• Infringe the intellectual property rights of any third party.
• Collect personal data from respondents without an appropriate legal basis or without their informed consent.
• Attempt to circumvent or reverse-engineer any part of the Service.
• Use automated tools to scrape or abuse the Service.

We reserve the right to suspend or terminate accounts that violate these rules, without notice and without refund.

6. Content and Ownership

6.1 Your content

You retain full ownership of the testimonials, surveys, and any other content you create or collect through the Service. By using the Service, you grant us a limited, non-exclusive licence to store, display, and transmit your content solely for the purpose of operating the Service.

6.2 Respondent content

You are responsible for ensuring that survey respondents consent to their testimonials being collected and displayed. You must not publish testimonials that respondents have asked to have removed.

You are solely responsible for the legality of any video testimonials collected through your surveys. This includes obtaining all necessary rights, consents, and authorisations from the individuals appearing in the videos, in compliance with applicable laws (including portrait rights, data protection law, and any sector-specific regulations). We accept no liability for video content uploaded by your respondents.

6.3 Our content

The Service itself (interface, code, branding) is the exclusive property of Léo Blouin and is protected by applicable intellectual property laws.

7. Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or reasons beyond our control (infrastructure outages, third-party service failures, etc.).

We shall not be liable for any loss or damage resulting from Service unavailability.

8. Limitation of Liability

To the fullest extent permitted by applicable law, our total liability for any claim arising from the use of the Service is limited to the amount you paid us in the 12 months preceding the claim.

We are not liable for any indirect, incidental, or consequential damages, including loss of revenue, data, or business opportunity, even if we have been advised of the possibility of such damages.

9. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page will always reflect the most recent version. We will notify registered users by email of any material changes at least 15 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.

10. Governing Law and Jurisdiction

These Terms are governed by French law. In the event of a dispute, and in the absence of an amicable resolution, the courts of France shall have exclusive jurisdiction.

If you are a consumer resident in another EU member state, you may also benefit from the mandatory consumer protection provisions of your country of residence.
